Subject: Final Opportunity to Continue in Service on Conditions

Dear [Employee Name],

In the domestic enquiry into charge sheet Ref. [Charge Sheet Number] dated [DD/MM/YYYY], the charge of [brief description] was found proved. Under the Standing Orders, such misconduct can attract a major penalty.

However, taking into account [reasons for leniency, e.g. long service, written undertaking dated DD/MM/YYYY, request of your representative or family circumstances], the management has decided to take a lenient view and give you a final opportunity to continue in service, subject to the following conditions for a period of [Number] months from [DD/MM/YYYY]:

  1. [Condition 1, e.g. You will not be absent without prior sanctioned leave.]
  2. [Condition 2, e.g. You will follow the cash-handling SOP and sign the daily reconciliation.]
  3. [Condition 3, e.g. You will attend counselling sessions arranged by HR.]
  4. You will maintain conduct in accordance with the Standing Orders at all times.

Your compliance will be reviewed by [Reporting Manager] and HR on [Review Date 1] and [Review Date 2]. At the end of the period, if all conditions are met, this letter will be closed.

Please note that if any condition is breached, the management may take action in respect of the breach and may also consider the proved misconduct referred to above, after giving you an opportunity to be heard, in accordance with the Standing Orders.

Acceptance by Employee

I have read and understood the above conditions, which were explained to me in [Language]. I accept them voluntarily and undertake to comply with them.

HR tips

  • Do not use the letter to waive the employee's legal rights
  • Apply leniency consistently so it does not appear discriminatory
  • Diarise the review dates and hold them
  • Any breach must still be handled through fair process

Conditional continuation arrangements should not override statutory rights or the standing orders. Review the conditions with a legal adviser before issue.
