HR tips

  • Never skip directly to a final warning for a minor first lapse unless policy allows it
  • Use the words 'may lead to' rather than promising a fixed penalty
  • Make sure every earlier warning gave the employee a chance to reply
  • Offer a meeting to discuss the letter and record the discussion

Can an employee be terminated after a final warning letter?+

A final warning does not by itself justify termination. If misconduct continues, the company should follow its standing orders, which usually means a charge sheet, an enquiry and a reasoned decision.

How many warnings are required before a final warning?+

Indian law does not fix a number. Most HR policies use two earlier written warnings, but follow what your own policy and standing orders say.

Should a final warning letter mention termination?+

It can mention that further lapses may lead to disciplinary action up to and including termination, after due process. It should not state that termination is already decided.
