Is demotion legal in India?+

Demotion as a penalty is permissible where the standing orders or service rules provide for it and it is imposed after a fair enquiry. Arbitrary demotion can be challenged.

Can salary be reduced on demotion?+

If the rules allow reduction to a lower pay scale as a penalty, salary may be revised accordingly. Where rules do not permit it, a pay cut needs the employee's consent.

Does demotion affect gratuity?+

Service continuity is not broken by demotion, so years of service continue to count. Gratuity is calculated on the last drawn wages at exit.
